1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of the OmniPix website at omnipix.artand related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. Description of the Service
OmniPix is an all-in-one studio that lets you generate images and videos using a range of third-party and proprietary AI models through a single, credit-based interface. Available models, features, and credit costs may change over time as we add, update, or retire models.
3. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to make purchases. By using the Service, you represent that you have the legal capacity to enter into these Terms and that you will comply with all applicable laws.
4. Accounts and Sign-In
You can create an account by signing in with Google. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. Notify us promptly at support@omnipix.art if you suspect unauthorised use of your account.
5. Credits, Plans & Billing
The Service uses a credit system. Each generation consumes credits based on the model and options selected. Credits have no cash value and are not redeemable for cash except where required by law.
- Free credits are provided on a periodic basis and may expire or reset according to the plan.
- One-time credit packs are added to your balance and, unless stated otherwise, do not expire.
- Subscription credits are granted for each billing period and may not roll over between periods.
Prices and credit allotments are shown on our Pricing page and may change on a prospective basis.
6. Payments & Merchant of Record
Payments are processed by Creem, which acts as the Merchant of Record for all purchases made through the Service. Creem handles payment processing and the calculation, collection, and remittance of applicable taxes (such as VAT, GST, or sales tax) based on your location. By completing a purchase, you also agree to Creem’s applicable terms. Your receipt and billing statement may reference Creem.
7. Subscriptions, Renewals & Cancellation
Subscription plans automatically renew at the end of each billing period at the then-current price until cancelled. You may cancel at any time; your plan remains active until the end of the current paid period, after which it will not renew. You can cancel or manage your subscription from your account in the Service, through the Creem customer portal linked in your receipt, or by contacting us at support@omnipix.art.
8. Refund Policy
Because credits can be used immediately to generate content, purchases are generally non-refundable except where required by law. If you experience a billing error, duplicate charge, or a technical problem that prevented you from receiving credits you paid for, contact us at support@omnipix.art within 14 days and we will review your request in good faith. Approved refunds are processed through Creem and returned to your original payment method.
9. Acceptable Use
You agree not to use the Service to create, upload, or distribute content that:
- Is illegal, infringing, defamatory, or violates the rights of others.
- Depicts sexual content involving minors, or non-consensual or exploitative material.
- Impersonates real individuals or creates deceptive deepfakes without consent.
- Promotes hate, harassment, violence, or self-harm.
- Contains malware, or attempts to disrupt, reverse engineer, or gain unauthorised access to the Service.
- Violates the usage policies of the underlying AI model providers.
We may remove content and suspend or terminate accounts that violate this policy.
10. Your Content and Ownership
As between you and OmniPix, you retain ownership of the prompts you submit and, to the extent permitted by applicable law and the terms of the underlying models, the images and videos you generate. Subject to your compliance with these Terms and your active plan, paid plans include a commercial-use licence for the content you generate. The free plan is limited to personal, non-commercial use.
You grant us a limited licence to host, store, and process your content as necessary to operate, secure, and improve the Service. You are responsible for ensuring that your use of generated content complies with applicable laws and third-party rights.
11. Intellectual Property
The Service, including its software, design, branding, and content (excluding user content and third-party models), is owned by OmniPix and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. All product names and trademarks of third parties are the property of their respective owners and are used for identification only.
12. Third-Party Models and Services
The Service integrates third-party AI models and services. Your use of outputs generated by those models may be subject to the providers’ own terms and usage policies. We are not responsible for third-party services and do not guarantee their availability or results.
13. Disclaimers
The Service and all generated content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated output may be inaccurate, unexpected, or offensive, and you are solely responsible for evaluating its suitability for your purposes.
14. Limitation of Liability
To the maximum extent permitted by law, OmniPix and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid to us in the three (3) months preceding the event giving rise to the claim.
15. Indemnification
You agree to indemnify and hold harmless OmniPix and its affiliates from any claims, damages, liabilities, and expenses arising out of your use of the Service, your content, or your violation of these Terms or applicable law.
16. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends, though certain provisions of these Terms will survive.
17. Governing Law
These Terms are governed by the laws of the operator’s principal place of business, without regard to its conflict-of-law rules. Any disputes will be subject to the exclusive jurisdiction of the competent courts located there, unless otherwise required by applicable law.
18. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
